What is the definition for "Miscarriage of Justice?"
According to dictionary.com
"the failure of a judicial system or court in the administration of justice, esp. when an innocent person is convicted of a crime"
Facts about this case:
10/04/1989 Raynard was convicted for a double homicide.
Problem with the case:
Raynard Vallery states he is innocent.
Usual facts of the case:
Lead detective Mark Arneson is currently serving 10 years in prison.
Evidence used against Raynard Vallery for conviction.
1. Detective Mark Arneson claims to have lost recorded interviews on tapes with witness before the trial.
2. One eye witness who testified for a plea bargain. A testimony from a known drug offender, who was not at the location of the crime.
Questionable issues:
1. Mark Arneson was proven to abuse his power within the LAPD.
2. The eye witness received a lesser sentence for his outstanding drug charges for a testimony against Raynard Vallery. During the trial, his story with facts and statements changed every time he was put on the stand. Details, like where and when these conversations took place and weapons used in the crime.
3. Raynard Vallery is willing to take a DNA test to prove his innocence.
Closing Raynard Vallery is still in prison, without a parole date.
This posting sounds very much like several that I have on my blog. I love reading these kinds of posts, and the "injustice" of justice that is not available to the poor.
